Four & Five will make commercially reasonable efforts to ensure the continuous availability of the Website. However, Four & Five does not guarantee that the Website shall be accessible or available at any time, from any geographic area or via each user device. The Website may for example not be available during periods of maintenance carried out by Four & Five or its hosting provider. In addition, we may suspend, withdraw or restrict the availability of all or any part of our Website for business and operational reasons.

10. Limitation of liability

Subject to the maximum extent permitted under applicable laws, Four & Five is not responsible or liable for:

  • any failure or delay in the performance of its obligations hereunder arising out of or caused by force majeure or outside our reasonable control;
  • for damages caused by you or any third parties or for any actions or failures to act based on any content available on our Website without obtaining specific legal advice from Four & Five; and/or
  • any indirect, punitive, special, consequential, or similar damage (including damages for loss of profit, lost revenue, loss of business, loss of corruption of data, loss of goodwill, and reputational damage), incurred due to the usage of the Website or any content available thereon.

To the maximum extent permitted under applicable law, Four & Five’s liability under these Terms is limited to the amounts effectively recovered under its professional liability insurance policy for the damage causing event. If, for any reason whatsoever, no effective recovery is obtained under the professional liability insurances, the liability of Four & Five shall be capped at the amount of fees invoiced to and effectively paid by the client for the relevant services, with an absolute maximum of 500,000 euros.
You agree, to the maximum extent permitted under applicable law, not to hold Four & Five’s directors, contractors, subcontractors, representatives, appointees, lawyers, employees, and other auxiliary persons personally or directly liable for or in connection with the (performance of the) services provided by Four & Five, its lawyers or personnel. In this respect, you waive any tort claim against the aforementioned persons. Any (liability) claim for or in connection with Four & Five’s services, our Website or the processing of your personal data (including any tort claim) will (may) be brought exclusively against Four & Five.

These Terms shall be governed by and construed in accordance with the laws of Belgium and the Parties hereto submit to the exclusive jurisdiction of the courts of Antwerp (division Antwerp), Belgium. The foregoing is without prejudice to any (consumer’s) right to present a dispute before a competent court on the basis of a mandatory statutory provision.
